Völker- und Europarecht), Veranstaltung: Internationale Organisationen, 12 Quellen im Literaturverzeichnis, Sprache: Deutsch, Abstract: Als Völkerrechtssubjekt bezeichnet man solche Einheiten, denen durch die Völkerrechtsordnung die Fähigkeit zuerkannt wird, Träger völkerrechtlicher Rechte und/oder Pflichten zu sein. Art und Umfang dieser Rechte und Pflichten richten sich nach der Natur des einzelnen Völkerrechtssubjekts und nach seiner Stellung in der Völkerrechtsordnung.
Noch bis in die erste Hälfte des 20. Jahrhunderts galten Staaten als einzige Völkerrechtssubjekte. Der seit 1945 enorm gestiegene grenzüberschreitende Verkehr von Waren, Personen und Finanzdienstleistungen machte jedoch eine institutionalisierte Form der Zusammenarbeit der Staaten nötig. Damit einher ging nicht nur die wachsende Anzahl und Bedeutung internationaler Organisationen (im Folgenden abgekürzt als i.O.), sondern auch die Frage nach Art, Umfang und Erwerb ihrer Völkerrechtssubjektivität.
Wegen ihrer Bedeutung als „Motoren des Völkerrechts“ werden Staaten als „geborene“ oder „originäre“ Völkerrechtssubjekte bezeichnet. I.O. dagegen können nur durch Zuweisung eigener völkerrechtlicher Rechten und Pflichten von den Mitgliedsstaaten in einer Satzung oder einem Gründungsvertrag zu Völkerrechtssubjekten „erkoren“ werden. Die Völkerrechtssubjektivität einer i.O. ist dabei jedoch zwei Einschränkungen unterworfen. Zum einen ist ihre Völkerrechtssubjektivität partiell, d.h. ihre Rechtspersönlichkeit reicht nur soweit, wie es zur Erreichung des Organisationszwecks erforderlich ist. Zum anderen ist ihre Völkerrechtssubjektivität relativ, da sie zunächst nur gegenüber den Mitgliedsstaaten gilt. Gegenüber einem Drittstaat kann eine i.O. erst als Völkerrechtssubjekt auftreten, wenn dieser die i.O. als solche anerkannt hat.
Einzig der UNO sprach der Internationale Gerichtshof in seinem Urteil zum Bernadotte-Fall von 1949 die uneingeschränkte bzw. universelle Völkerrechts-subjektivität zu. Der IGH hatte in seinem Gutachten festgestellt, dass die Gründungsstaaten der UN, die die überwiegende Mehrheit der internationalen Gemeinschaft repräsentierten, die Rechtsmacht besessen hatten, eine Einheit mit universeller Völkerrechtssubjektivität zu schaffen, die auch gegenüber Dritten ohne deren Anerkennung wirkt.
Durchaus umstritten ist daher, dass Organisationen wie z.B. multinationalen Konzernen oder internationalen Nichtregierungsorganisationen bis heute keine Völkerrechtssubjektivität zuerkannt wird.
