Sämtliche Angaben des Prospektes müssen leicht analysierbar und in verständlicher Form geschrieben sein, so dass dem Publikum ein zutreffendes Urteil über die finanzielle Lage in der Vergangenheit und Zukunft des Emittenten und jedes Garantiegebers sowie der mit den Wertpapieren verbundenen Rechte ermöglicht wird (§5 Abs. 1 WpPG). Die BaFin prüft lediglich „auf Vollständigkeit und auf innere Widerspruchsfreiheit, die so genannte ‚Kohärenz’. Eine bonitätsmäßige Überprüfung oder Prüfung auf inhaltliche Richtigkeit erfolgt nicht“. Da dies nicht im Aufgabenbereich der BaFin liegt, besteht hier ein Risiko für den Anleger. Die Informationen zur Bonität und zu den inhaltlichen Angaben muss sich der Anleger bei Dritten informieren, die diese Angaben bestätigen können.
