Eine zentrale Aufgabe jeder Rechnungslegung ist, die am Bilanzstichtag bestehenden Lasten und die damit verbundenen künftigen Ausgaben abzubilden. Die Bilanzierung sicherer Verpflichtungen, wie etwa Verbindlichkeiten gegenüber Kreditinstituten, gestaltet sich dabei weniger problematisch als die Bilanzierung von Rückstellungen für ungewisse Verpflichtungen. Den Rückstellungskriterien kommt daher die Funktion zu, die passivierungspflichtigen Sachverhalte möglichst trennscharf und den Zwecken des Jahresabschlusses entsprechend zu definieren.1 Die Behandlung dieser bedeutenden Bilanzposition beeinflusst in erheblichem Maße die Zweckadäquanz eines Rechnungslegungssystems.2 Die Regelungen zur Rückstellungsbilanzierung nach IFRS und nach HGB weisen zumindest im Detail nicht unerhebliche Unterschiede auf. Zurückzuführen ist dies vor allem auf die abweichende Zielsetzung der beiden Rechnungslegungssysteme. Der Zweck der IFRS besteht in der Vermittlung entscheidungsnützlicher Informationen, während das HGB auf die Ermittlung und Begrenzung eines ausschüttungsfähigen Gewinns abstellt. Informationen müssen im System der IFRS sowohl relevant, d. h. materiell bedeutsam, als auch zuverlässig, also möglichst unbeeinflusst durch Wahlrechte und Ermessensentscheidungen, sein. Folglich stehen auch bei der Rückstellungsbilanzierung nach IFRS nicht der Gläubigerschutz und das Vorsichtsprinzip, sondern die Informationsbedürfnisse der Bilanzadressaten im Vordergrund.3
Der Rechnungsinhalt eines Standards ist am Rechnungszweck zu messen.4 Die vorliegende Arbeit verfolgt daher zum einen das Ziel, die Vorschriften zur Rückstellungsbilanzierung nach IAS 37 zu erläutern, wesentliche konzeptionelle Unterschiede und Gemeinsamkeiten zum HGB aufzuzeigen und die Vereinbarkeit von IAS 37 mit der Gesamtzielsetzung der IFRS zu hinterfragen. Besonders problembehaftet erscheint in diesem Zusammenhang die Berücksichtigung von Wahrscheinlichkeiten auf der Ansatzebene. In einem zweiten Schritt erfolgt die Darstellung und kritische Würdigung der geplanten Änderungen zur Rückstellungsbilanzierung durch ED IAS 37...
