In his article “Humanizing the Beast”, Thomas E. Wartenberg focusses on King Kong’s transgression from the stereotypical racist representation of the Black male sexual monster of Skull Island to the romantic hero in the New York sequence. He argues that the film reverts the racism constructed in its first half and uses the second half to propagate that “it is a mistake to see Black men as sexual monsters because they are human beings like all of us” (Wartenberg 175). Rather than rating the ape’s personality in the New York sequence as a positive depiction of Black masculinity, I would argue that the stereotypical representation of the sexually aggressive black male was merely transformed into another stereotype, namely the non-threatening, desexualized noble negro; the latter no longer possesses any evil character traits but is nonetheless destructed in his inferior weakness in order to restore white womanhood to its pedestal and reinforce white capitalist male power structures.

Organisational culture can be defined as “the basic values, ideologies and assumptions which guide and fashion individual and business behaviour.” (Wilson and Rosenfeld 1990, p.229). Following Schein, organisational culture can be subdivided into three levels, representing the visibility to the observer. Most visible are the culture’s artefacts or surface manifestations, including organisational structure, processes, physical environment, technology and products, employees clothing, manners of address as well as language and company myths. These and other artefacts can be discovered while interacting with the organisation as an employee, customer or other stakeholder. The second level are espoused beliefs and values. The companies set of values normally establishes over a long period emerging from the founders and managements own mindset. These values are (or better should be) adopted by all employees as a part of their own values and beliefs and are also manifested as stated company values. The third and most in-depth level of organisational culture are the underlying basic assumptions. They evolve when beliefs and values become treated as reality, though they are never visible to an observer and can be described as the company’s own culture (Schein 2004). An important factor, when looking at organisational culture is the similarity or differences of the management’s and the employee’s view of corporate culture. A high match of organizational culture levels results in a strong organisational culture whereas differences in both groups’ mindsets lead towards a weak culture. Important thereby is not only a match of the culture’s manifestations, which only leads to a superficial strong culture, much more significant is sharing of the same values and underlying assumptions (Hartog and Verburg 2004). In a strong organisational culture, common thinking and views between employers and employees may eventually result in a better working atmosphere, an alignment of the workforce and ultimately in better performance (Deal and Kennedy 2000). Weak corporate cultures on the other hand are marked by less shared values, beliefs and assumptions and are less stringent in its thinking but are therefore also more open to changes and fluctuations. Im zweiten Kapitel werden die Hauptthesen des Humanismus erläutert und mit der Theorie der klientenzentrierten Gesprächspsychotherapie von Carl Rogers untermauert. Im dritten Kapitel werden das humanistische Menschenbild und Rogers Theorie an einem Beispiel angewandt. Zum Abschluss folgt eine Stellungnahme zur humanistischen Theorie. „Das Menschenbild ist der begriffliche Rahmen, auf dessen Basis menschliches Tun beschrieben wird und der fundamentale Wert definiert. Damit liefert das Menschenbild zugleich ein grundlegendes Erklärungsmodell und einen Rahmen für die Entwicklung konkreter Handlungsstrategien.“ (König 2005, S. 34) Konkret heißt das, dass man das menschliche Verhalten erklären kann, wenn man weiß welches Menschenbild eine Person hat. D.h. zum einen ist das Menschenbild ein Erklärungsmodell für das Verhalten einer Person und zum anderen kann man darauf aufbauend konkrete Handlungsstrategien entwickeln, wenn man weiß welches Menschenbild eine Person hat. Man kann Probleme oder Situationen auf der Basis eines Menschenbildes deuten. (vgl. König 2005, S.34) Jedes Menschenbild ist immer an eine Überzeugung oder eine Lehre gebunden und jeder Mensch besitzt ein ganz bestimmtes Menschenbild oder eine Mischung aus verschiedenen Menschenbildern, auch wenn diese Tatsache dem Menschen nicht immer bewusst ist. Ich würde z.B. von mir selbst nicht behaupten, dass ich immer ein humanistisches Menschenbild vertrete. In der Pädagogik gibt es viele Menschenbilder, wie z.B. das rationalistische, behavioristische oder das humanistische Menschenbild. Auf das letztere soll im Folgenden genauer eingegangen werden.

Die Schüler sind unterschiedlich belastbar und haben eine individuelle Leistungsmotivation, die vor allem von ihren Interessen, Neigungen und Bedürfnissen gesteuert wird. Ferner bringen sie verschiedene Fähigkeiten, Fertigkeiten und auch Defizite mit, die das Lerntempo beeinflussen. Nicht zuletzt sind die Konzentrationsfähigkeit und das Leistungsvermögen unterschiedlich ausgeprägt.
Daraus entsteht eine pädagogische Begründung, die im Sinne der Chancengleichheit eine gezielte Förderung der individuellen Anlagen anstrebt. Die in vielen Belangen ungleichen Schüler sollen nicht gleich, sondern ihren Möglichkeiten gerecht werdend unterrichtet werden. D. h. „nicht die Gleichheit, die Homogenität einer Klasse darf das Ziel unserer pädagogischen Bemühungen sein, sondern die bestmögliche Förderung eines jeden einzelnen Kindes“ (R. Christiani 1994, S. 18). Dieses Ziel ist nur in einem differenzierten Unterricht zu erreichen. Dieser zeichnet sich dadurch aus, dass er
-Allen Kindern tragfähige Grundlagen vermittelt (zu beachten Leistungsschwache mehr Lernzeit, mehr Zuwendung, spezielle Lerninhalte)
-Alle Kinder ihrer individuellen Lernmöglichkeiten entsprechend herausfordert und fördert (Schwierigkeitsgrad der Aufgaben, Aneignungs- und Handlungsformen (konkret, sinnlich oder symbolisch, zusätzliche Lernangebote, Sozialformen, Medienauswahl etc.)
-Interessen und Neigungen weckt und ausbaut (z. B. anregungsreiche Lernumgebung)
-Selbstständigkeit und soziale Fähigkeiten der Kinder entwickelt (z. B. selbstgesteuertes Handeln) (R. Christiani 1994).

Vermeintliche Gründe dafür könnten die großen Unterschiede zwischen leistungsstarken und leistungsschwachen Schülern sein. Seitdem es die zweiphasige Juristenausbildung gibt, wird deren Reform ebenso häufig wie fruchtlos diskutiert. Einen wesentlichen Kritikpunkt der gegenwärtigen Juristenausbildung bildet die von den Studenten und vor allem den Referendaren kaum mehr sinnvoll zu bewältigende Expansion des Rechtsstoffes, der Judikatur und der Literatur. Wohl auch daher gibt es zunehmend Juristen, die nach dem erfolgreichen Bestehen der ersten juristischen Staatsprüfung direkt als Wirtschaftsjuristen in Unternehmen und Verbänden tätig sein wollen, ohne sich das harte Brot des Rechtsreferendariates und der großen Staatsprüfung anzutun. Schon Kötz hat sich vor einem Vierteljahrhundert für den Titel des „Diplom-Juristen“ ausgesprochen. Erst kürzlich hat Derleder sehr plastisch formuliert, dass „der früher stets Unbenennbare, der das erste Staatsexamen bestanden hat“ sich jetzt „immerhin“ als Diplom- Jurist bezeichnen dürfe. Nun trifft dies zwar auf die meisten der Hochschulabsolventen zu, längst jedoch nicht auf alle. Es gibt immer noch eine ganze Reihe von Universitäten, die den Absolventen mit erstem Staatsexamen den Anspruch auf (Nach-)Diplomierung versagen. Das OVG Saarlouis hat zwar mit seinem wegweisenden Urteil vom 29.01.2001 festgestellt, dass der Nichterlass einer Diplomierungssatzung für Juristen durch eine Universität rechtswidrig ist: Den Vorteilen einer Diplomierungsordnung für Juristen stünden keine Gemeinwohlbelange von erheblichem Gewicht gegenüber. Ein Hochschulabsolvent mit erstem juristischem Staatsexamen habe somit letztendlich einen Anspruch auf (Nach-)diplomierung. Und die meisten Hochschulen haben mittlerweile auch reagiert und den Abschlussgrad eines Diplom-Juristen eingeführt. Aber eben noch längst nicht alle Hochschulen.

Eine Lösung, durch die endlich der „gesunde Menschenverstand zu seinem Recht käme“ muss gefunden werden, um mit Tomaschekzu sprechen.
