In Südafrika stellt Affirmative Action ein Thema dar, welches sowohl von Fachleuten als auch von der breiten Öffentlichkeit heftigst diskutiert wird. Es zeigt vielmehr auf interessante Weise die Verzahnung zwischen Recht/Politik, Wirtschaft und Gesellschaft in einem Land auf, das nach langer Zeit endlich den Weg zur Demokratie fand und im Jahre 2004 deren zehnjähriges Jubiläum feierte.
Auch in den USA wird Affirmative Action nicht nur als juristisches, sondern ebenfalls als politisches Thema von allen Gesellschaftsgruppen wahrgenommen. Hier bezieht sich Affirmative Action jedoch auf die Förderung von Minderheiten, wohingegen im südafrikanischen Kontext die Förderung der Mehrheit propagiert wird (vgl. Dupper 2005, S. 91). Im Gegensatz hierzu findet der Begriff in einem kulturell homogeneren Land wie Deutschland weniger Anklang und wird, wenn überhaupt, nur im Zusammenhang mit Frauenquoten erwähnt (vgl. Gas 2002, S. 7).
Die folgende Arbeit verfolgt daher das Ziel, dem deutschen bzw. europäischen Leser das Thema Affirmative Action am Beispiel seiner Erscheinungsform in Südafrika näher zu bringen. Schließlich zeigen die kürzlichen Ereignisse in Frankreich auf, dass mit einer zunehmenden Heterogenisierung europäischer Länder auch hier das Thema Affirmative Action bald von enormer Aktualität sein könnte, was die Stellung ethnischer Sondergruppen wie z.B. den Maghrebinern in Frankreich betrifft.
Die Arbeit beleuchtet zunächst die Zusammensetzung der südafrikanischen Bevölkerung und gibt einen Überblick über die Zeit der Apartheid und ihrer Gesetzgebung bevor auf die Verankerung von Affirmative Action als Mittel zur Gleichheitserzielung in der neuen Verfassung Südafrikas eingegangen wird. Es folgt eine Darstellung der wesentlichen Erscheinungsformen von Affirmative Action in Südafrika, die insbesondere auch für ausländische Investoren von Bedeutung sind. Die Arbeit endet mit einer Wertung zum Thema Affirmative Action in Südafrika, die u.a. auch auf eigenen Beobachtungen und Gesprächen mit Südafrikanern basiert und alternative Wege zu Affirmative Action aufzeigt.
